Springer-Verlag Italia Srl (“Springer”) operates this website (the “Springer Site”) for access and use by medical doctors, radiology technicians and other medical-services providers and medical-research professionals. The Springer Site is made available to you conditioned on your acceptance without modification of these terms of use. Your use of the Springer Site constitutes your agreement to these terms of use. Your use of other sites provided by Springer or any affiliate of Springer may be subject to additional terms, notices and policies posted on that website, and those additional terms shall control as to that Springer site.

 

THESE TERMS OF USE CONSTITUTE YOUR AGREEMENT ON THE USE OF THE SPRINGER SITE. YOU SHOULD THEREFORE CAREFULLY READ THIS AGREEMENT BEFORE USING THE SPRINGER SITE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OF USE, WE ASK THAT YOU EXIT THIS WEBSITE.

 

1 . User Eligibility.

The Springer Site is provided by Springer and is available only to people and entities who can form legally binding agreements. If you do not qualify, do not use the Springer Site. Unless otherwise explicitly specified on the Springer Site, the information on the Springer Site is intended solely for use and access by access and use by medical doctors, radiology technicians and other medical and research professionals. If you are a non-medical reader, please consult your physician regarding any medical issues relating to diseases, condition, symptoms, diagnoses, prognoses, treatments and side effects. Access to the Springer Site may not be legal by others or by persons in certain countries. Any statements about the products, services, materials, protocols, procedures and techniques of Springer or others on the Springer Site that are specific to certain territories should only be referred to and interpreted in relation to those territories. For example, any reference to protocols for contrast media in the United States may only be referred to and interpreted as references to the United States, to the exclusion of all other territories. While reasonable efforts are made to present contrast medium doses and other quantities accurately, Springer advises you that methods, techniques and clinical uses or indications involving drug and contrast medium usage and other treatments described on the Springer Site should only be considered in conjunction with the applicable manufacturer’s own literature and the full prescribing information for the applicable territory. Certain products, services, materials, protocols, procedures and techniques referenced on the Springer Site may not be available in certain territories. You should not construe anything on the Springer Site as a promotion or solicitation for any product or service or for the use of any product or service that is not authorized by applicable law and regulation. Springer Site may contain links to third-party websites that may be appropriate only to one or more particular territories or to particular users.

The Springer Site is not intended for use by children under the age of thirteen. We will not knowingly collect information about children under the age of thirteen and will otherwise comply with applicable laws and regulations of other territories. We ask that any user of the Springer Site monitor the use of the Springer Site by children under their care and make sure that those children are aware of the dangers of providing information about themselves over the Internet. We also would like to make you aware of the availability of commercial parental control software that will better enable you to monitor and, where necessary, block access by children to the Internet.

 

2. License and Springer Site Access.

Springer grants you a limited personal, nontransferable, non-sublicensable, revocable worldwide license to access and make personal, non-commercial use of the Springer Site. You may view, copy and print limited quantities of material from the Springer Site, as long as the material is used by you for information only and the material is used only for non-commercial purposes and not for sale or further distribution. Any rights not expressly granted by this agreement are reserved by Springer.

 

3. Springer Site is Not a Source of Medical or Therapeutic Advice.

Information presented on the Springer Site, including information regarding health-related issues, the beneficial characteristics of products, services, materials, protocols, procedures and techniques may be presented in summary form. Information may also be general in nature. Under no circumstances is information to be construed as medical advice or professional advice concerning health-related topics. You should not use information on the Springer Site or any website linked to it (each, a “Linked Website”) as a substitute for any recognized diagnostic or treatment tool or technique.

 

4. Intellectual-Property Ownership and Use. 

All intellectual property associated with the Springer Site, including its content and the trademarks, service marks, trade dress and proprietary designs appearing on the Springer Site or referenced in it, are the sole property of Springer, its vendors, licensors, licensees or other third parties. Any rights associated with any such intellectual property are retained by the owner and are protected by applicable law. These terms of use expressly prohibit any use of any intellectual property associated with the Springer Site except as otherwise expressly specified in the Springer Site or as otherwise expressly authorized by Springer in writing.

 

5. Restrictions on Use.

The Springer Site is protected by national and international law, including copyright and trademark laws. These terms of use do not grant any license to modify, alter or frame the materials on the Springer Site that are viewed, downloaded or otherwise accessed by you. Springer reserves the right to disable any unauthorized links or frames. If you desire to provide a link from your website to the Springer Site, or to frame it, you must contact Springer for permission via the contact method provided on the Springer Site. Springer will be under no obligation, however, to permit any link or frame.

Your license under these terms of use does not include: any right of resale or of commercial use of the Springer Site or its contents; any derivative use of the Springer Site or its contents; or any use of data mining, robots, or similar data-gathering and extraction tools in connection with the Springer Site. You may not remove or alter any proprietary notices, including copyright notices, contained on any downloadable materials and you must comply with all applicable end-user license agreements, website policies and terms of use. You may not input or upload onto the Springer Site any information or computer code that is intended to, or are likely to, damage, interfere with, alter, intercept or expropriate any data or system, or that infringes any intellectual-property rights of Springer or any third party. Inappropriate inputs and uploads include Trojan horses, worms, time bombs, cancelbots and other unauthorized computer programming routines. You are also prohibited from posting or transmitting any unlawful, threatening, obscene, libelous, or otherwise offensive material, or engaging in any kind of harassment activity via the Springer Site or any Linked Website.

 

6. Product and Service Information.

Springer may provide new features or information on the Springer Site, each of which will be subject to these terms of use. We encourage you to visit the Springer Site from time to time to review the new information provided on them to review the current versions of their respective terms of use.

Springer shall have no responsibility for errors of any kind on the Springer Site, any other site provided by Springer, or any Linked Website. Errors may include incorrect product and service descriptions, typographical errors and obsolete information, with the result that product and service descriptions, pricing information and the descriptions of promotional offers or other data may not be complete, current or accurate. Errors may result in the failure to honor a request placed by you based on incorrect information. Because actual colors and the “look and feel” you see on the Springer Site will depend on your monitor and other technical factors, Springer cannot guarantee that any video or graphic display of any information or other data will be accurate at any time.

Springer and the providers of products and services referenced on the Springer Site reserve the right to discontinue the production of any product, and to discontinue the offering or sale of any product or service at any time, without notice. Materials, protocols, procedures and techniques may be modified, superseded or eliminated at any time, without notice. The display of, or any reference to, any product, service, material, protocol, procedure or technique on the Springer Site or any Linked Website does not signify that it is or will be available in any territory. In particular, protocols as to contrast media may vary from territory to territory, without reference or notice, and territorial variances should be carefully referenced at all times. Springer cannot guarantee that any particular product or service displayed on the Springer Site will be available through any particular source, even if that source shall have indicated that the product or service is available through it.

Any prices stated by Springer on the Springer Site are suggested prices only; all prices accessed by you through the Springer Site or otherwise provided to you are subject to change without notice and might not include shipping and handling or any applicable sales taxes or customs duties. Springer will not be a party to any sales transaction or other transaction you may make with any source, either online, by telephone or otherwise. Springer therefore can make no guarantee that any source will fulfill any product order or honor any other commitment, promise or obligation to you.  

 

7. Submissions.

Any questions, comments, suggestions, testimonials, endorsements, ideas or similar material disclosed, submitted or posted by you on the Springer Site or in connection with them will be considered non-confidential, non-proprietary and not personal either to you or to anyone else. By so disclosing, posting or submitting any such material, you grant to Springer and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, edit, publish, translate, rework, distribute and display that material without compensation or acknowledgment of source. You may be asked to agree to additional terms upon submission of certain content or materials (e.g., testimonials) to the Springer Site, and these terms of use shall in no way limit those additional terms.

If you make a submission, you represent and warrant that you own or otherwise control the rights to your submission. You further represent and warrant that your submission will not contain software viruses, spiders, spybots, commercial solicitation, chain letters, mass mailings, or any other form of spam. You may not use a false name or identity-obscuring or misleading e-mail address, impersonate any person or entity, or otherwise mislead us as to the origin of any submission. You agree to indemnify us for all claims arising from or in connection with any claims to any rights in any submission.

 

8. Privacy Considerations.

From time to time, we may offer users of the Springer Site the opportunity to receive information, special offerings, and promotions. We may also solicit requests from users for contact information for others who might be interested in Springer products and services referenced on the Springer Site. Users can exercise the option of receiving e-mailed information and announcements through the link provided at the bottom of the newsletter email message.

In order to take advantage of the full capabilities of the Springer Site, such as the participation in certain special offerings, and to receive e-mailed information and announcements, you may be asked to send us information about yourself. Providing that information is entirely voluntary on your part, and your use of many aspects of the Springer Site will still be possible if you elect not to provide that information.

The submission by you of any information about yourself while using the Springer Site constitutes consent by you to the collection, use and disclosure of that information by Springer in accordance with these terms of use. The Springer Site may use passive information devices, including, without limitation, the collection of Internet IP addresses and navigational data and the use of cookies.   When you view the Springer Website, Springer may store some data on your computer in the form of a “cookie” to recognize your computer automatically the next time you visit. Cookies can help providers of websites in a number of ways; for example, it can help tailor a website the better to match your interests or to store you password and to save you from having to re-enter it each I\me. If you do not wish to receive cookies, you might choose to configure your Internet browser to erase all cookies from your computer’s hard drive, block all cookies or to receive a warning before a cookie it stored.

Although Springer takes reasonable steps to protect information that you may submit to it through the Springer Site, Springer cannot guarantee the security of that information. You should also bear in mind that Internet transmissions are never completely secure, nor can they be guaranteed error-free. You therefore understand that, by use of the Springer Site, you are assuming the security risk for any information that you transmit through it.

Although Springer has no obligation to monitor any information provided to the Springer Site by users, including information that you provide, Springer reserves the right to monitor, retain and disclose that information if required to do so by law or in a good-faith belief that disclosure is reasonably necessary to comply with legal requirements, to respond to claims that any information violates the rights of third parties, or to protect the rights, property or personal safety of Springer, its users or the public.

This is to inform you that Italian Law no.196/03 provides for the protection of persons and other subjects regarding treatment of their personal data.

As the party concerned, users are entitled to the rights laid down in art.7 of the above said Law 196/03:

 

7 – Right of the concerned party

1. In relation to the handling of personal data the concerned party has the right:

a) to be made aware of the existence of the handling of data that may concern him/her; for this purpose, the concerned party shall be granted free access to the register referred to in Article 31, sub-section 1, letter a);

b) to be informed of those matters indicated in Article 7, sub-section 4, letters a), b) and h);

c) to obtain without delay – through the owner or manager – the following:

1) the confirmation that personal data concerning him/her exists or not, even if such data has not been registered, and the notification in an intelligible form of such data and their origin, as well as how and to what purpose his/her data will be handled. The request may be renewed, barring the existence of justified motives, with a time interval of no less than ninety days;

2) the deletion, transformation in anonymous form or the block of the data handled in violation of the law, including those data whose preservation is not necessary in relation to the purposes for which the data has been collected or subsequently handled;

3) the updating, correction or, should he/she deem it appropriate, the integration of data;

4) the declaration that the procedures referred to in 2) and 3) – as well as their content – have been made known to those to whom the data were communicated or diffused, except where this proves impossible or involves the use of means clearly disproportionate with respect to the protected right;

d) to oppose, wholly or partially, for legitimate reasons, the handling of his/her personal data, although they are pertinent to the purpose of the collection.

e) to oppose, wholly or partially, the handling of his/her personal data for purposes of commercial information or for sending advertising material or for direct selling, or for carrying out market research or interactive commercial communication, and to be informed by the owner, at the time when the data is communicated or diffused, of the possibility to exercise such right free of charge.

2. For each request as referred in sub-section 1, letter c), number 1) a charge may be asked of the concerned party, where the existence of data concerning him/her is unconfirmed; such charge may not be in excess of the costs actually sustained, and shall be in accordance with the procedures, and within the limits set forth by the rules as referred to in Article 33, sub-section 3.

3. The rights as referred to in sub-section 1 regarding personal data on deceased persons may be exercised by anyone who has interest.

4. In exercising such rights referred to in sub-section 1, the concerned party may confer authorization or proxy in writing to persons or associations.

5. The rules regarding confidentiality of those exercising the profession of journalist are still in effect, limited to the source of information.

9. No Warranty

The Springer Site, including any content or information contained within it and any Linked Websites, are provided “as is” and “as available.” AS TO THE SPRINGER SITE, AND ANY SUCH LINKED WEBSITE, TO THE FULLEST EXTENT PERMITTED BY LAW, SPRINGER EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, HOWSOEVER CLAIMED.

Without limitation to the foregoing, Springer makes no warranty: (a) that there will be no interference with your enjoyment of the Springer Site; (b) that the information provided will fulfill any particular purpose or need; (c) that the information provided is complete, reliable or accurate; (d) that any request will be honored according to your schedule or any stated schedule; (e) that the Springer Site will otherwise meet any specifications, requirements or expectations; (f) that the Springer Site will be uninterrupted, timely, secure or error free; (g) that the results that may be obtained from use of the Springer Site will be accurate and reliable; (h) that any errors in the content of the Springer Site will be corrected; (i) that materials on the Springer Site are appropriate or available for use in any particular location; or (j) that products or services displayed or referenced on the Springer Site are available for use in any particular location.

You assume total responsibility and risk for your use of the Springer Site, other sites provided by Springer, and any Linked Website. Any material downloaded or otherwise obtained through the use of the Springer Site or other sites provided by Springer shall be so obtained at your own discretion and risk. Springer will not be responsible for any damage to your computer system or loss of data that results from so obtaining any such material.

 

10. Limitation of Liability.

IN NO EVENT SHALL SPRINGER, ITS AFFILIATES, OTHER RELATED ENTITIES, SUBSIDIARIES, JOINT VENTURES, PARTNERS, ENTITIES IN SUBSTANTIAL COMMON CONTROL OR THEIR RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS OR EMPLOYEES BE LIABLE FOR ANY LOST PROFITS, LOST OPPORTUNITIES OR ANY DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY ARISE, DIRECTLY OR INDIRECTLY, FROM ACCESS TO THE SPRINGER SITE, FROM THE USE OF THE SPRINGER SITE OR ANY LINKED WEBSITES, FROM THE INABILITY TO USE THE SPRINGER SITE OR ANY LINKED WEBSITES, THROUGH THE DOWNLOADING OF ANY CONTENT (INCLUDING, WITHOUT LIMITATION, DATA, TEXT, IMAGES, VIDEO, OR AUDIO FROM THE SPRINGER SITE) OR IN CONNECTION WITH ANY VIRUSES, BUGS, ACTION OR INACTION OF ANY COMPUTER SYSTEM, TELEPHONE LINE, HARDWARE, SOFTWARE OR PROGRAM MALFUNCTION, OR ANY OTHER ERROR, FAILURE OR DELAY IN DATUM TRANSMISSION OR NETWORK CONNECTION, EVEN IF ADVISED OF THE POSSIBILITY OF THAT DAMAGE. Springer shall have no liability for the deletion of any communications or information collected, maintained or transmitted by the Springer Site or the failure to store any information, including personalized settings. Springer has no liability with respect to any information posted by users on chat rooms, bulletin boards or other user fora.

 

11. Modifications.

We may change or revise these terms of use from time to time by updating this posting. Without limitation, Springer reserves the right to change its general practices and restrictions regarding use of the Springer Site at any time, in its sole discretion, with or without notice. Your use of the Springer Site reaffirms your continuing agreement to the then-current version of these terms of use.

 

12. Termination.

Springer may, in its sole discretion, terminate your use of the Springer Site or cancel or terminate your rights under these terms of use for any reason, without prior notice. Upon termination or cancellation, you will immediately discontinue use of the Springer Site. In its sole discretion, and at any time, Springer may also discontinue providing the Springer Site or any one or part of them, with or without notice. Springer shall not be liable to you or any third party for any of the foregoing. Sections 3, 4, 7, 8, 9, 10, 13, 14 and 15 shall survive the expiration or termination of these terms of use.

 

13. Sponsorship and Linked Websites.

Springer has no control over Linked Websites and shall not be responsible for the availability of Linked Websites or their content. Access of Linked Websites is at your own risk. Linked Websites (and any websites to which they may link) may contain information about uses of products that have not been approved or cleared by applicable governmental or self-regulatory bodies. Third-party websites (and any websites to which they link) may also contain information that is inaccurate, incomplete, or outdated. Bracco International B.V. is a sponsor and provider of content on the Springer Site. Other entities may also sponsor content on the Springer Site or provide content accessible on it or through Linked Websites. 14. Jurisdiction and Choice of Law.

All claims regarding the Springer Site shall be governed according to the laws of Italy, without regard to its conflicts of law principles. Any claim or action arising under these terms of use shall be subject to the exclusive jurisdiction of courts in Milan, Italy.

 

15. Complete Agreement.

These terms of use constitute the entire agreement between you and Springer with respect to use of the Springer Site, superseding any other agreement between you and Springer with respect to the subject matter of these terms of use. Section headings in these terms of use are for convenience only and have no legal or contractual effect. If any provision of these terms of use shall be found to be unenforceable, the other provisions shall still remain in full force and effect.
